Whenever one discusses "land use" in the same sentence as government, one must stop and think:

  1. Whose property is it?  The government's or a private citizen's?
  2. Is anyone being objectively harmed?

Ownership means control--and the control of one's own property is essential in a free society.  When one buys a piece of land, it is only the seller who has a right to set the conditions for the sale.  Restrictive covenants are where conditions are set.

The Courts are the proper place for disputes among property owners when one alleges that another is harming them or their property.  The arbitrary determinations of bureaucrats in the name of "peaceful enjoyment" are a violation of the rights of property owners.
